Helping Parents Understand Their Child Support Rights and Responsibilities

Child support is an important part of every divorce involving minor children. If you anticipate that you will be paying child support, or if you believe you will be receiving child support, an Elgin child support attorney can be an important part of protecting your rights in your divorce. The Elgin law firm of Brady & Jensen assists parents across Kane County and beyond

Under Illinois law, net income is calculated by taking a noncustodial parent's gross income and subtracting income taxes, Social Security contributions, mandatory retirement contributions, any union dues, health insurance premiums, other support obligations and any necessary medical expenses. The Illinois Child Support Guidelines outline the amount of support the noncustodial parent will be required to pay. The current guidelines are as follows:

Number of Children Percentage of Net Income
One20 percent
Two28 percent
Three32 percent
Four40 percent
Five45 percent
Six of more50 percent

Courts will not deviate from this statutory formula except in rare circumstances. Child support is generally a fairly straightforward part of any divorce. In certain situations, however, it can become difficult to calculate a parent's net income, particularly when he or she is self-employed or works seasonally. Our law firm is able to take on all types of unique family law situations for our clients. We also help clients who want to modify their child support arrangements. In Illinois, parents are generally required to pay child support to any child under the age of 19 who is still in high school.
