Over the past few decades, state governments and law enforcement agencies have taken a number of measures to enhance the penalties associated with driving under the influence. These penalties can include the suspension or loss of your driver's license, fines, probation and community service. In the most serious cases, you face the possibility of jail or prison time.
If you have been accused of DUI/DWI in Kane County or the surrounding areas, call the DUI/DWI lawyers of Brady & Jensen. Our criminal defense attorneys can help you challenge the charges and minimize the consequences.
Working to Help Clients Stay on the Road After a DUI Charge
One aspect of a drunk driving charge that many people do not think of is the fact their driver's license may be suspended. If you failed or refused to take the Breathalyzer test, the state of Illinois can suspend your driver's license. If you do not take action to contest the suspension of your license, the state will suspend it automatically. Our lawyers can represent you in your license hearing. We will explore all potential defenses in order to help you keep your license.
Even if your license is ultimately suspended, we may be able to help you receive a Monitoring Device Driving Permit (MMDP). An MMDP is generally available to people after their license has been suspended for 31 days. With an MMDP license, you will be required to install a Breath Alcohol Ignition Interlock Device (BAIID) in your vehicle.
Taking Strong Action Against Criminal Allegations
We will fight the underlying criminal charges just as hard as we will fight for your right to drive. We will closely examine all of the evidence. Did the police have probable cause to stop your car? Did they perform the Breathalyzer tests correctly? Is the physical evidence (the results of the breath test, blood sample or urine sample) compromised in any way? We will get answers to these questions and help you achieve the best possible result, whether it is a plea agreement that minimizes some of your consequences, a dismissal of the charges prior to trial, or an acquittal at trial.
