Challenge Field Sobriety Test In Illinois

A typical timeline in a DUI arrest in Illinois consists of:

  • A traffic stop at a roadside safety check point or in traffic as a result of probable cause
  • A request for a driver to submit to field sobriety tests such as the "walk the line" test or the "pen gaze" test
  • If the police officer suspects drunk driving on the basis of the field sobriety tests, an arrest and a trip to the police station
  • A request for a driver to submit to chemical testing of breath, blood or urine in an attempt to determine the driver's blood alcohol content (BAC)
  • If the driver's BAC is above a certain level, negative consequences, including:
    • Temporary loss of driving privileges
    • Opportunity to post bond
    • Possible towing and impound of vehicle
