Car accident in Illinois kills 1on Interstate 255

Despite the best efforts of the Illinois State Police to espouse the virtues of safe driving, accidents still happen. That was the case in St. Clair County on Sept. 1 when a crossover car accident killed one out-of-state woman and left her husband clinging to life. So far, police have not filed any formal charges in the accident, which involved two other vehicles. It does not appear that anyone else was injured in the crash.

According to the accident report, the vehicle carrying the husband and wife was headed south on Interstate 255 when a vehicle traveling in the opposite direction sideswiped a pickup truck. That truck crossed the median and struck the car head-on, trapping both individuals inside. While firefighters worked to free them from the wreckage, the wife succumbed to her injuries and was later pronounced dead.

The man was airlifted to a hospital in his home state of Missouri, just over the border. The driver of the pickup truck apparently left the scene before authorities arrived. The initial driver who sideswiped the truck was stopped and issued a citation for improper lane changes, but she was not judged to be impaired at the time of the accident. No further charges have yet been filed.

As the investigation continues, it is possible the initial driver may yet face criminal charges for her role in the car accident. Even if she does not, however, Illinois law states the husband is entitled to sue for personal injury and for wrongful death on behalf of his wife in a civil court setting. However, evidence of negligence that is deemed to have proximately caused the accident will be required in order for the civil suit to be a success.
