Guidelines for elderly medical malpractice victims in Illinois

Many Illinois residents have, at some point, gone to the hospital to get medical attention. Anyone who has ever been sick is aware that doctors can be powerful and influential. If a trained doctor is negligent, not only can it possibly lead to severe injuries and damages, but the victims are often left with serious physical and emotional scars. Illinois state laws allow the medical malpractice victim to initiate a lawsuit against such negligent doctors and medical practitioners in order to make them more legally accountable.

One of the most vulnerable classes in a medical malpractice case is the elderly population. In most cases with elderly patients, the previous medical records also need to be taken into account in order to administer the proper treatment to the patient. Age-related complications have to be factored in by the attending physician to help treat the elderly patient.

However, the patient's age is often discussed by the defense attorneys in a medical malpractice lawsuit, which can help the negligent doctor. Thus, the loved ones of the elderly victim often find it beneficial to get more information about presenting evidence that can prove malpractice in court.

At Brady & Jensen, LLP, Attorneys at Law, we have observed that even in cases where the medical malpractice has been proven in the court, the amount of compensation that the judge may consider appropriate for a senior citizen is often considerably less than that of a younger person who has been a victim of medical malpractice. However, there are various cases in which the senior citizen has won the medical malpractice lawsuit along with the deserved compensation.
