What is the Food Safety Modernization Act?

Each year around the holidays people from Illinois get together with their family and friends to enjoy each other's company. Oftentimes, people will enjoy food and drink at these events. People trust that the food products that they are consuming are safe for them. However, the reality is that people in Illinois, and across United States, get sick each year from dangerous food products.

Some food manufactures fail to take the appropriate measures to keep consumers safe. Food products can contain harmful chemicals, or other inedible components. They can even be infected with dangerous bacteria.

In an effort to keep people safe, the federal government has enacted the Food Safety Modernization Act. Under this act, the Food and Drug Administration has the right to create prevention-based controls that can help protect the food supply in the United States. Specifically, the FDA has the right to create science-based standards for production of fruits and vegetables and other food products created in the United States.

Additionally, the FSMA gives the FDA the right to inspect and monitor the importation of food products from outside the United States. The FDA now inspect products that are being imported into the United States to ensure that they are meeting safety standards.

The FSMA also gives the FDA mandatory recall powers over contaminated food products. This helps the FDA protect the public health in case dangerous products reach the market.

While federal laws are in place to help people, many Illinois residents will still get sick from dangerous food products this holiday season. When people are injured by dangerous food products, legal action might be necessary. Through a products liability lawsuit, people may be able to receive compensation for their injuries.
